Growtyx provides a cloud-based (SaaS) digital service used predominantly for commercial or professional purposes. Before starting a subscription, we recommend reviewing the terms below along with Growtyx's Terms of Service.
Growtyx services are digital SaaS services that include software access, data analysis, running the Crawler, AI APIs, and the use of other server-based resources.
The Service may begin to be provided and made available electronically as soon as the subscription starts.
For transactions with Growtyx's Users who purchase the service for commercial or professional purposes, the right-of-withdrawal provisions under consumer legislation do not apply.
For transactions where consumer legislation applies, the right of withdrawal and its exceptions set out in the relevant legislation apply. Legal exceptions relating to services performed instantly in electronic form, and other mandatory consumer rights, remain reserved.
The fact that the Service has started being used, that resources such as the Crawler or AI have been used, or that the relevant subscription period has begun, does not by itself grant the User a right to a refund beyond what is provided in the agreement or under mandatory law.
Growtyx is not obligated to refund fees that have not been earned back under applicable law, the rules of the payment institution/Merchant of Record (MoR), and these terms.
The User may cancel their active subscription via their Growtyx account or through other valid methods offered by Growtyx.
Unless explicitly stated otherwise, cancellation takes effect at the end of the current paid billing period. The User may continue to benefit from the services offered under the relevant plan until the end of the current billing period.
After cancellation, the subscription is not automatically renewed for the next period and no charge is made for the new period.
After the paid period ends, access to the account or to certain features may be restricted. Rules on exporting and retaining the User's data are subject to the data export and deletion provisions set out in the Terms of Service.
If an access interruption of 48 continuous hours or longer occurs due to infrastructure under Growtyx's own control, additional usage time equal to the length of the interruption is added to the User's subscription free of charge.
This does not cover interruptions caused by force majeure, third-party infrastructure or API providers, payment infrastructure, internet service providers, or events reasonably outside Growtyx's control.
This remedy is a service remedy provided by Growtyx under these Cancellation and Refund Terms. Rights arising from mandatory legislation remain reserved.
If the User:
Growtyx may temporarily suspend the account or terminate the agreement in accordance with the Terms of Service.
In such a case, the refund of fees for the unused period, in terminations arising from the User's breach, is evaluated within the framework of the applicable contractual provisions and law. Mandatory consumer rights remain reserved.
Payment transactions may be carried out through the payment institution or Merchant of Record (MoR) used by Growtyx.
The payment method, collection, chargeback, refund and related financial transactions may also be subject to the relevant payment institution's or MoR's own terms.
Where a refund is required, Growtyx carries out the relevant refund through the applicable payment infrastructure.
These terms do not limit the User's rights that exist under law and cannot be waived by contract.
On matters relating to cancellation, refunds and termination of the Service, this document is to be read together with Growtyx's Terms of Service, the applicable Distance Sales and Digital Service Terms, Privacy/KVKK Policy, and the relevant payment/MoR terms.
Applicable mandatory provisions of law between these documents remain reserved.
