The individual or legal entity who registers on the Growtyx Platform and purchases the service.
Growtyx services are primarily offered for commercial or professional use. Where the User acts as a consumer and the transaction falls within the scope of Turkey's Law No. 6502 on the Protection of Consumers and related legislation, the mandatory statutory rights granted to consumers remain reserved.
The subject of this document is to set out the basic sales, payment, subscription and withdrawal/cancellation terms for the SaaS subscription and related digital services the User purchases through the Growtyx Platform.
Depending on the selected plan, the services offered by Growtyx may include SEO analysis, site crawling, e-commerce performance analysis, conversion analysis, reporting, AI-powered analytics, and similar SaaS features.
The scope of the service and the available features are determined according to the terms specified on the relevant plan and pricing page at the time of purchase.
Access to the purchased SaaS plan may be provided electronically upon successful completion of the payment transaction and activation of the account.
Growtyx services are provided over the internet and via remote access.
The User may need to grant the necessary account and integration authorizations in order to use the Service.
If the third-party services, APIs, or integrations necessary for Growtyx to provide the Service are not authorized by the User, or cannot be used for technical reasons, the relevant features of the Service may be unavailable.
Service fees are specified on the pricing and payment screen shown to the User at the time of purchase.
Applicable taxes and any other mandatory fees are stated before purchase, in addition to the displayed prices.
Payment transactions may be carried out through the payment institution or Merchant of Record service provider used by Growtyx.
We aim not to store credit card details within Growtyx's own systems. The storage and processing of payment information may be carried out within the payment service provider's own systems and policies.
For transactions using a Merchant of Record, payment, billing, tax, chargeback and related payment processes may be subject, in whole or in part, to the relevant Merchant of Record provider's own terms.
For monthly or annual subscription plans, if the Service continues at the end of the selected subscription period, the subscription may be renewed in accordance with the terms specified at the time of purchase.
Where automatic renewal applies, the User is informed of the renewal terms and pricing at the time of purchase.
The User may cancel their subscription before the next renewal using the available cancellation methods in their account or through the relevant payment provider.
Unless stated otherwise, cancelling the subscription does not prevent the User from using the Service until the end of the current paid subscription period.
As Growtyx services are primarily offered to B2B Users acting for commercial or professional purposes, the consumer right-of-withdrawal provisions under Turkey's Law No. 6502 on the Protection of Consumers do not apply to transactions that do not qualify as consumer transactions.
Where the User acts as a consumer and the transaction falls within the scope of consumer legislation, the mandatory provisions enacted in favor of consumers under the relevant legislation remain reserved.
For a transaction subject to consumer legislation, the statutory provisions apply with respect to services performed instantly in electronic form and other exceptions to the right of withdrawal set out in the relevant legislation.
Where performance of the service must begin before the consumer's withdrawal period expires, the necessary approval and disclosure processes required by law are applied.
Refund and cancellation terms may also be described in Growtyx's current Cancellation and Refund Terms.
No provision may be interpreted in a way that removes rights granted to consumers by law that cannot be limited in advance.
Records relating to registration, purchase, subscription, payment, cancellation and similar transactions carried out electronically may be retained for the purposes of establishing the agreement, providing the Service, resolving disputes, and fulfilling applicable legal obligations.
For transactions subject to consumer legislation, the retention periods for information and documents required under the relevant legislation are additionally taken into account.
The User may terminate their subscription through the relevant cancellation method.
Access under the relevant plan may end once the paid subscription period expires.
Growtyx may suspend the account or terminate the Service, in accordance with the relevant contractual provisions, in cases such as failure to meet payment obligations, misuse of the Service, unlawful use, security risk, or breach of the Terms of Service.
Legally mandatory rights remain reserved.
Where the User acts as a consumer and the transaction falls within the scope of consumer legislation, the remedies and jurisdiction rules provided for consumers under Law No. 6502 and related legislation apply.
For B2B transactions and disputes falling outside the scope of consumer legislation, the provisions on Turkish law and the competent court/enforcement office set out in Growtyx's Terms of Service apply.
This document is to be read together with Growtyx's Terms of Service, Privacy and Cookie Policy, the Data Processing Agreement (if any), and the plan/pricing terms presented to the User at the time of purchase.
In the event of a conflict between these documents, the document specifically governing the relevant subject and the applicable mandatory provisions of law shall prevail.
The scope of services offered by Growtyx, plan features, and prices may change according to the terms specified on the purchase screen.
